1. Purpose and Scope

The artworks offered on the Website are original creations made by independent artists. Each artwork is described as accurately as possible, including:

  • Technique used (oil painting, acrylic, watercolor, sculpture, etc.)
  • Medium (canvas, paper, wood, etc.)
  • Year of creation
  • Condition of the artwork

The photographs presented are as faithful to reality as possible. However, color variations may appear depending on your screen calibration.

3. Ordering and Prices

3.1 Ordering Process

To place an order, the Buyer must:

  1. Select the desired artwork
  2. Add the artwork to cart
  3. Fill in the contact details form
  4. Choose the delivery method
  5. Validate the order after reading and accepting these Terms and Conditions
  6. Proceed with secure payment

3.2 Prices

Artwork prices are indicated in Euros (€), all taxes included (TTC). They include VAT applicable on the order date. Shipping and insurance costs are indicated separately before final order validation.

5. Shipping and Liability

The Website acts solely as a technical intermediary between the Artist and the Buyer. The preparation, professional packaging, and shipping of the artwork are the sole responsibility of the Artist.

5.1 Shipping Process

  1. Notification: The artist receives automatic notification upon payment validation
  2. Packaging: The artist professionally packages the artwork to ensure protection during transport
  3. Carrier Selection: The artist selects an appropriate carrier (DHL, FedEx, UPS, etc.)
  4. Insurance: The artist purchases insurance at the time of shipment to cover the artwork's value
  5. Tracking: The buyer receives a tracking number to monitor their artwork's delivery

5.2 Delivery Times

Delivery times vary according to:

  • Metropolitan France: 3 to 7 business days
  • Europe: 5 to 10 business days
  • International: 10 to 20 business days

These times are indicative and may vary depending on artist availability and carrier constraints.

5.3 Shipping and Insurance Costs

Shipping costs include:

  • The actual transport cost
  • Artwork insurance during transport
  • Professional packaging materials

5.4 Receipt and Verification

Upon receiving the artwork, the Buyer must:

  1. Check the package condition in the presence of the carrier
  2. In case of visible damage, note reservations on the delivery slip
  3. Take photos of the damaged package
  4. Contact the artist and Website immediately within 48 hours

5.5 Limitation of Liability

In the event of damage, loss, or any dispute related to transit, the Website shall not be held liable, as the sales and delivery contract is strictly between the Artist and the Buyer. The Buyer must contact the Artist who will activate the insurance procedure with the carrier.

6. Right of Withdrawal

In accordance with European consumer protection legislation, the Buyer has a period of 14 calendar days to exercise their right of withdrawal, without having to justify reasons or pay a penalty.

The withdrawal period runs from the date of receipt of the artwork.

To exercise this right, the Buyer must notify their decision to withdraw by:

The Buyer must return the artwork in its original packaging, in perfect condition, within 14 days following notification of their decision. Return costs are the Buyer's responsibility, unless otherwise agreed.

6.4 Refund

The refund will be processed within 14 days from receipt of the returned artwork, less return costs if these are the Buyer's responsibility.

Exception: Artworks made to the Buyer's specifications or clearly personalized (custom orders) are not eligible for the right of withdrawal.

7. Warranties

7.1 Authenticity

The Artist guarantees the authenticity and originality of each artwork. A certificate of authenticity, signed by the artist, accompanies each sold artwork.

7.2 Conformity

In case of non-conformity of the delivered artwork compared to the description, the Buyer has 48 hours after receipt to report it by email with supporting photos.

8. Intellectual Property

Acquiring an artwork transfers material ownership of the object, but does not transfer the copyright attached to the work. The Artist retains their intellectual property rights.

The Buyer therefore agrees not to reproduce, represent, or commercially exploit the artwork without prior written authorization from the Artist.

10. Governing Law and Jurisdiction

These terms and conditions are governed by the laws of [Your Country].
